TextFlow, Inc. ("TextFlow," "we," "our," or "us") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our platform, website, and services (collectively, the "Services").

Please read this policy carefully. If you disagree with its terms, please discontinue use of our Services.

We collect information you provide directly when you create an account, use our Services, or communicate with us, including:

We do not sell your personal information to third parties, and we do not use the content of your messages for advertising purposes.


3. How We Share Your Information

3.1 Service Providers

We share information with trusted vendors who assist in operating our Services (e.g., cloud hosting, payment processing, analytics). These parties are contractually bound to use your data only as directed by us and in compliance with applicable privacy laws.

3.2 Business Transfers

If TextFlow is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you via email and/or a prominent notice on our website before your data becomes subject to a different privacy policy.

3.3 Legal Requirements

We may disclose your information if required to do so by law, court order, or governmental authority, or if we believe disclosure is necessary to protect the rights, property, or safety of TextFlow, our users, or others.

3.4 With Your Consent

We may share your information with third parties when you have given us explicit consent to do so.


4. Data Retention

We retain your personal information for as long as your account is active or as needed to provide the Services. You may request deletion of your account and associated data at any time by contacting us at privacy@textflow.co. We will fulfill deletion requests within 30 days, subject to any legal retention obligations.


5. Data Security

We implement industry-standard technical and organizational measures to protect your information, including:

  • Encryption of data in transit (TLS 1.2+) and at rest (AES-256)
  • SOC 2 Type II certified infrastructure
  • Role-based access controls and audit logging
  • Regular penetration testing and vulnerability assessments

No system is completely secure. In the event of a data breach affecting your rights or freedoms, we will notify you and applicable regulators as required by law.


6. Cookies

We use cookies and similar technologies to recognize you, remember your preferences, and analyze platform usage. You can control cookie preferences through your browser settings. Note that disabling certain cookies may affect the functionality of our Services.

We do not use cookies to track you across third-party websites for advertising purposes.


7. Your Rights

9. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will notify you by email or by posting a prominent notice on our platform at least 14 days before the changes take effect. Your continued use of the Services after that date constitutes acceptance of the updated policy.

Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TextFlow platform, website, and related services (the "Services") provided by TextFlow, Inc. ("TextFlow," "we," or "us"). By accessing or using the Services, you agree to be bound by these Terms.

If you are using the Services on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.


1. Accounts

1.1 Registration

To access most features of the Services, you must create an account. You agree to provide accurate, complete, and current information during registration and to keep your account information updated.

1.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@textflow.co if you suspect unauthorized access to your account.

1.3 Eligibility

You must be at least 18 years old and legally capable of entering into contracts to use the Services. Users in certain jurisdictions may face additional restrictions under local law.


2. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not use the Services to:

  • Send unsolicited messages (spam) or violate anti-spam laws including the CAN-SPAM Act, TCPA, or CASL
  • Transmit messages to recipients who have not consented to receive them
  • Distribute malware, phishing content, or any harmful code
  • Harass, threaten, or abuse any individual or group
  • Violate any applicable law, regulation, or third-party rights
  • Attempt to gain unauthorized access to any system or network
  • Reverse engineer, decompile, or disassemble any part of the Services
  • Resell or sublicense the Services without our written consent

TextFlow reserves the right to suspend or terminate accounts that violate this section without notice.


3. Messaging Compliance

You are solely responsible for ensuring your use of TextFlow's messaging features complies with all applicable laws, including the Telephone Consumer Protection Act (TCPA), GDPR, CASL, and carrier guidelines. This includes:

  • Obtaining proper consent from recipients before sending messages
  • Honoring opt-out requests promptly
  • Maintaining accurate records of consent
  • Including required disclosures in marketing messages

TextFlow provides tools to assist with compliance but does not guarantee compliance with all laws in all jurisdictions. You assume full legal responsibility for your messaging activities.


4. Subscription and Billing

4.1 Plans and Fees

Access to the Services requires a paid subscription. Fees are described on our Pricing page and are subject to change with 30 days' notice. All fees are in US dollars unless otherwise stated.

4.2 Billing Cycle

Subscriptions are billed monthly or annually in advance. Annual plans are non-refundable except as required by law. Monthly plans may be cancelled at any time; access continues until the end of the current billing period.

4.3 Free Trials

If you sign up for a free trial, your account will not be charged until the trial period ends. You may cancel before the trial ends to avoid charges. We reserve the right to modify or discontinue free trial offers at any time.

4.4 Late Payments

Overdue accounts may be suspended after reasonable notice. We reserve the right to charge interest on overdue amounts at the lesser of 1.5% per month or the maximum rate permitted by law.


5. Intellectual Property

5.1 Our IP

The Services, including all software, designs, text, and branding, are owned by TextFlow or its licensors and are protected by intellectual property laws. These Terms do not grant you any ownership rights in the Services.

5.2 Your Content

You retain ownership of all content you submit through the Services ("Your Content"). By using the Services, you grant TextFlow a limited, non-exclusive license to host, store, and process Your Content solely to provide and improve the Services.

5.3 Feedback

If you provide suggestions or feedback about the Services, you grant us an unrestricted, royalty-free right to use that feedback without any obligation to you.


6. Confidentiality

Each party agrees to keep confidential any non-public information disclosed by the other party and to use such information only to fulfill obligations under these Terms. This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.


7. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.


8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEXTFLOW'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO TEXTFLOW IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

IN NO EVENT SHALL TEXTFLOW BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.


9. Indemnification

You agree to defend, indemnify, and hold harmless TextFlow and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the Services, Your Content, or your violation of these Terms or applicable law.


10. Term and Termination

These Terms remain in effect while you use the Services. Either party may terminate the agreement at any time. Upon termination, your right to access the Services ceases immediately. Sections relating to intellectual property, disclaimers, limitation of liability, and governing law survive termination.

We may terminate or suspend your account immediately for material breach of these Terms, including violation of the Acceptable Use policy.


11. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved through binding arbitration administered by JAMS under its Streamlined Arbitration Rules, conducted in San Francisco, California. You waive any right to participate in a class-action lawsuit or class-wide arbitration.


12. Changes to These Terms

We may modify these Terms at any time. For material changes, we will provide at least 14 days' notice via email or in-product notification. Continued use of the Services after that date constitutes your acceptance of the revised Terms.
